In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR), the following Privacy Policy has been established and made available:

The Privacy Policy defines the rules for collecting, storing, processing and using personal data obtained by the online store www.apearl.eu (hereinafter referred to as the “Store”) by DE TIAN Sp. z o.o., with its registered office at: ul. Edmunda Bałuki 24, 70-407 Szczecin, entered into the National Court Register kept by the District Court Szczecin – Centrum in Szczecin under KRS number 0000130199, NIP 852-04-10-694, acting as the data controller (hereinafter referred to as the “Controller”).

The Controller makes every effort to respect your privacy and protect personal information provided while using the Store and making purchases, and undertakes all necessary measures to ensure data security.

When and what personal data do we collect?

While using the Store and its subpages, you may be asked to provide data in the following cases:

1. Registering an account in the Store
2. Placing an order in the Store
3. Commenting on the blog and products
4. Subscribing to the mailing list (Newsletter)

In the above cases, you may be asked to provide one or more of the following data:

1. first and last name,
2. shipping address and billing address (if different),
3. e-mail address,
4. phone number,
5. company name and tax identification number (for invoices).

Providing the above data is voluntary, but necessary to complete a purchase, register an account or subscribe to the newsletter.

While browsing the Store, information such as IP address, browser type, operating system, browsing time and referral source may be collected automatically.

Data made available on social media platforms (Facebook) may also be collected when interacting with our Facebook page “Biżuteria z pereł - Apearl.eu”.

For what purposes do we use your data?

We primarily use your personal data to process orders and returns and to send notifications regarding order status and delivery.

We also use your data to handle complaints and warranty claims.

Additionally, your data may be used to create and maintain your account, provide order history, allow account settings management, save products in the cart or wishlist, present personalized recommendations, and enable product reviews.

If you give your consent (by subscribing to the newsletter), your e-mail address will also be used for marketing purposes related to the Store’s own products. Consent may be withdrawn at any time.

Data may also be used for marketing profiling purposes (e.g. Google Ads and Facebook Ads remarketing). Profiling does not produce legal effects or significantly affect the user.

The legal basis for data processing is:

a) performance of a contract (Art. 6(1)(b) GDPR),

b) consent (Art. 6(1)(a) GDPR),

c) legal obligations of the Controller (Art. 6(1)(c) GDPR),

d) legitimate interests of the Controller (Art. 6(1)(f) GDPR).

To whom do we disclose personal data?

Data provided to external entities are used solely to provide our services.

For the purpose of contract performance, the Store may share data with:

1. courier companies DPD, Poczta Polska S.A., and InPost,
2. The Rocket Science Group, LLC (Mailchimp) – newsletter service provider,
3. cyber_Folks S.A. – hosting provider,
4. PayPro S.A. – payment provider (Przelewy24).

Personal data may be transferred to third countries (e.g. the USA) in connection with Google, Facebook and Mailchimp tools, using appropriate safeguards such as Standard Contractual Clauses.

The scope of shared data is limited to the necessary minimum. Data may also be disclosed to public authorities if required by law.

We never sell or share personal data with third parties for marketing purposes.

What rights do you have?

1. Right of access to data.

2. Right to rectification of data.

3. Right to data portability.

4. Right to erasure (subject to legal obligations and claims).

5. Right to object to direct marketing.

6. Object to processing based on legitimate interest (Art. 6(1)(f) GDPR).

7. Withdraw consent at any time.

8. Lodge a complaint with the President of the Personal Data Protection Office (UODO).

How long do we store your data?

Your data will be stored:

1. for the duration of the contract,
2. after its termination for the period required by law (e.g. 5 years for accounting purposes),
3. until consent is withdrawn (for marketing purposes).

How do we protect your personal data?

Communication between your device and our server is encrypted using SSL protocol. Databases are protected against unauthorized access in accordance with GDPR and Polish data protection law.

The Controller has not appointed a Data Protection Officer, as it is not required under Article 37 GDPR

Newsletter messages

The newsletter is sent only to users who have given prior consent. It contains information about the Store, products, promotions and informational content.

You may correct your data, request deletion or data transfer at any time.
