REGULATIONS OF THE INTERNET STORE (binding since 24.12.2014)

§1

General provisions


1. Apearl online store [hereinafter "Store"] conducts retail sales via the Internet, on the basis of these Regulations [hereinafter "Regulations"].

2. owner is: DE TIAN Sp. z o.o.. with its registered office in Szczecin, Obrońców Stalingradu 24 , registered in the National Court Register kept by the District Court of Szczecin-Centrum in Szczecin under KRS number: 0000130199 NIP: 852-04-10-694

3. The buyer can be an adult individual, legal person or organizational unit without corporate status, hereinafter referred to as the "Customer".

4. All prices quoted by the Seller are expressed in Polish currency and are gross prices (including VAT). Prices of goods do not include the cost of delivery, which is specified in the "cost of delivery" tab.

5. Goods available in the Store are free from any physical and legal defects.

§2

Orders

1. Orders can be placed as follows:


     a) via the form available on the apearl.eu website,
 
     b) by e-mail at the address available on the apearl.eu website,
 
     c) by telephone on the numbers intended for placing orders, available on the apearl.eu website on the Contact tab.

2. A condition of fulfilling the order is that the Customer provide data allowing verification of the Customer and the recipient of the goods. The store confirms receipt of the order by e-mail or telephone.

3. Parties are bound by the information contained on the apearl.eu website next to the purchased goods at the time of order, in particular: the price, product characteristics, features, items included in the set, delivery date and method.

4. The information on the stores website does not constitute an offer within the meaning of the Civil Code. Customer placing an order makes an offer to purchase certain goods. The contract of sale is concluded when the Customer confirms the Order by clicking the confirmation link in the e-mail sent to the Customer by the store.

§3

Payment

1. The customer can choose from the following forms of payment:

a) cash on delivery - payment is made in cash on delivery of the goods,

b) by transfer - then the Store reserves the goods in its warehouse and sends them to the address specified by the Customer after the payment is credited to the bank account indicated for that purpose on the Store's website or in an e-mail to the Customer,

c) in another way, if it is specified on the Store's website.

§4

Shipping of goods

1. The ordered goods Store sends via shipping companies (the Polish Post Office or a courier company) along with the document of sale selected by the Customer (invoice / receipt / bill) to the address specified by the Customer or makes the goods available for pick up by the Customer at the Store.


2. In the case of payment by any method other than cash on delivery, the shipping time is extended by the period between placing an order and the date of crediting the amount due to the Stores bank account.

§5

Complaints

1. The Seller is liable to the Consumer in the event of non-conformity of the goods with the contract for two years from the date of purchase of the goods in accordance with Article 10 of the Act of 27 July 2002 on specific conditions of consumer sale.

2. In the case of not meeting the requirements of the agreement the Customer should send back to the Store the claimed goods together with a description of what the discrepancy is. Return should take place immediately, no later than within fourteen days.

3. The basis for the adoption of the complaint is to present proof of purchase of goods by the customer (receipt or invoice VAT).

4. Store respond to the customer complaint within 14 days from the return of the goods together with a description of non-compliance.

5. The cost of sending the Customer a new product or removing the discrepancies in the case of a justified complaint is covered by the Store

§6

Right of withdrawal from the contract

1. The customer has the right to withdraw from the contract without giving reasons within 10 days of delivery of the ordered goods, in accordance with the general principles of the regulations on concluding distance contracts.

2. Store returns the amount paid for the goods to the Customer along with the cost of shipping within 7 days of returning the goods, transfer is made to the Customer's bank account specified with the returned goods

3. The right to withdraw from the contract is not entitled to the Customer in the cases specified in art. 10 sec. 3 of the Act of March 2, 2000 on the protection of certain consumer rights and liability for damage caused by a dangerous product, i.e. in the scope of:

- services with the properties specified by the customer in the order placed by him or closely related to his person,

- services which, due to their nature, cannot be returned or whose subject quickly deteriorates.

§7

Privacy protection

1. The Seller undertakes to protect the Customer's personal data in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws 2002.101.926 -jt) and the Act on the provision of electronic services (Journal of Laws 2013.1422 -jt ). By providing his personal data to the Seller, the Customer agrees to their processing by the Seller in order to complete the order.

2. The Customer may also express a separate consent to receive advertising and promotional materials from the Store, including a commercial newsletter (Newsletter).

3. The customer has the right to inspect their data and correct them, as well as to demand their removal.

§8

Intellectual property

It is forbidden to use any materials published on the Store's website (including photos and descriptions of goods) without the Store's written consent.

§9

Binding regulations and changes

1. The current version of the regulations is always available to the customer in the regulations tab (http://apearl.pl/regulamin-zakupow).

2. The Customer is bound by the regulations accepted by the Customer at the time of placing the order, unless the current version is more advantageous for the Customer and the Customer informs the Seller about the selection of the current regulations as applicable when settling the Customer's claims related to the purchase.

3. Registered customers of the Store will be notified of changes to the regulations by email (to the e-mail address provided during registration or ordering). The notification will be sent at least 30 days before the new regulations enter into force. The changes will be introduced in order to adapt the regulations to the applicable legal status.

4. None of the provisions of the regulations is intended to infringe any rights of the Customer. In the event of non-compliance of any provision of the regulations with the applicable law, the provisions of the law shall apply in place of the contested provision of the regulations and the Seller shall immediately amend the regulations in order to adapt them to the applicable law.

5. The correct operation of the store is guaranteed in the following browsers: IE version 7 or newer, FireFox version 3 or newer, Opera version 9 or newer, Chrome version 10 or newer, Safari with the latest JAVA and FLASH versions installed, on screens with horizontal resolution above 1024 px. Using third-party software that affects the functioning and functionality of browsers: Internet Explorer, FireFox, Opera, Chrome, Safari may affect the correct display of the store's content, therefore, in order to obtain full functionality of the store, it is recommended to disable them.

6. In matters not covered by these regulations, the relevant applicable legal provisions shall apply.

7. Disputes are considered by a court having local and material jurisdiction.

1. The Apearl online store [hereinafter "Store"] available at the domain www.apearl.pl conducts retail sales via the Internet, pursuant to these Regulations [hereinafter "Regulations"], with which Customers can contact at the following e-mail address: sklep @ apearl.eu

The owner of the Store is: DE TIAN Sp. z o. o. with its seat in Szczecin, Obrońców Stalingradu 24, 70-407Szczecin, entered into the National Court Register kept by the District Court Szczecin - Centrum in Szczecin under KRS number: 0000130199 NIP: 852-04-10-694, contact telephone number 91- 485-47-80

3. The Buyer may be an adult natural person, a legal person or an organizational unit without legal personality, hereinafter referred to as the "Customer"


4. All prices quoted by the Seller are expressed in Polish currency and are gross prices (including VAT). The prices of goods do not include the cost of delivery, which is specified in the "delivery cost" tab - http://apearl.pl/koszt-dostawy.


5. The goods available in the Store are free from physical and legal defects.

§2

Orders


1. Orders can be made in following ways:


a) via the form available on the Store's website,


b) emailem na adres dostępny na stronie internetowej Sklepu,


c) telefonicznie na numery przeznaczone do składania zamówień, dostępne na stronie internetowej Sklepu w zakładce Kontakt.


2. Warunkiem realizacji zamówienia jest podanie przez Klienta danych pozwalających na weryfikację Klienta i odbiorcy towaru. Sklep potwierdza przyjęcie zamówienia emailem lub telefonicznie.


3. Dla stron wiążące są informacje zawarte na stronie internetowej Sklepu przy kupowanym towarze w momencie złożenia zamówienia, w szczególności: cena, charakterystyka towaru, jego cechy, elementy wchodzące w skład zestawu, termin i sposób dostawy.


4. Informacje znajdujące się na stronie internetowej Sklepu nie stanowią oferty w rozumieniu Kodeksu Cywilnego. Klient składając zamówienie składa ofertę zakupu określonego towaru. Do zawarcia umowy sprzedaży dochodzi z chwilą potwierdzenia Zamówienia przez Klienta poprzez kliknięcie w link potwierdzający w mailu przysłanym Klientowi przez Sklep.


5. Umowa zawarta pomiędzy Klientem a Sklepem dotycząca zakupu danego produktu ma charakter terminowy i trwa przez okres realizacji zamówienia. Miejscem spełnienia świadczenia związanego z zakupem produktów w Sklepie jest adres dostawy wskazany przez Klienta.

§3

Payment

1. The customer can choose from the following forms of payment:

a) cash on delivery - payment is made in cash on delivery of the goods,

b) by transfer - then the Store reserves the goods in its warehouse and sends them to the address specified by the Customer after the payment is credited to the bank account indicated for that purpose on the Store's website or in an e-mail to the Customer,

       c) in another way, if it is specified on the Store's website.

§4

Shipping of goods

1. The ordered goods are sent by the Store via shipping companies (Poczta Polska or a courier company) along with the sales document selected by the Customer (invoice / receipt / bill) to the address provided by the Customer in the order form or makes the goods available for collection by the Customer at the Store's premises. The VAT invoice may be delivered electronically to the e-mail address provided by the Customer, unless the Customer expressly indicates that the VAT invoice should be delivered in a traditional form.

2. In the case of payment other than cash on delivery, the shipping date is extended by the period between placing the order and the date the payment is credited to the Store's bank account.

3. The product delivery time is no more than 30 days from the date of the contract. The deadline for receiving the shipment is each time the order is completed, plus the delivery time.

§5

Complaints


1. Complaints may be submitted electronically by sending them to the Store's e-mail address: sklep@apearl.eu or in writing to the Store's address provided in the upper part of the Regulations, at the Store's expense.

2. The customer has the right to demand a price reduction or to withdraw from the contract, unless the store immediately and without undue inconvenience to the customer replaces the defective product with a non-defective one or removes the defect. This limitation does not apply if the product has already been replaced or repaired by the Store or the Store has not replaced the product with a defect-free one or has not removed this defect.


3. The store recognizes the complaint within 14 days from the date of its receipt. If the Store does not respond to the Customer's requests within 14 days, it means that the requests have been recognized by the Store as justified.

4. The customer should send the advertised goods back to the Store. The return should be made immediately, not later than within fourteen days.


5. The costs of sending the customer a new product or removing non-compliance in the event of a justified complaint shall be borne by the Store.


6. The store is responsible for product defects under applicable law. In the case of a sale that is not a consumer sale, the provisions on warranty contained in the Civil Code are excluded.


7. In accordance with applicable regulations, the consumer has the right to return the Goods without giving any reason within the time limits indicated in § 6 of the Regulations, with the proviso that the benefits and products cannot be withdrawn from the purchase under the applicable regulations.

§6

The right to withdraw from the contract


1. The 14-day period for withdrawal from the contract begins:


1) for a contract in the performance of which the Store issues an item, being obliged to transfer its ownership - from taking possession of the item by the Customer or a third party designated by him other than the carrier, and in the case of a contract which:


a) includes many items that are delivered separately, in batches or in parts - from taking possession of the last item, batch or part,

b) consists in regular delivery of items for a specified period of time - from taking possession of the first item;


2) for other contracts - from the date of the contract.


2. To exercise the right to withdraw from the contract, the Customer must inform the Store about his decision to withdraw from the contract by an unequivocal written statement sent by mail to the Store's address provided in the upper part of the Regulations or by e-mail to the following e-mail address: sklep@apearl.eu. The customer may also use the withdrawal template provided below.

3. The right to withdraw from the contract does not apply to contracts:

1) for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who has been informed before the commencement of the service that after the entrepreneur has fulfilled the service, he will lose the right to withdraw from the contract;

2) where the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline to withdraw from the contract;

3) in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy his individual needs;

4) in which the subject of the service is an item that deteriorates quickly or has a short shelf-life;

5) in which the subject of the service is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the packaging has been opened after delivery;

6) in which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items;

7) where the subject of the service are alcoholic beverages, the price of which was agreed upon conclusion of the sales contract, and the delivery of which may take place only after 30 days, and the value of which depends on fluctuations in the market over which the entrepreneur has no control

8) in which the consumer expressly demanded that the entrepreneur came to him for urgent repair or maintenance; if the entrepreneur provides additional services other than those requested by the consumer, or provides items other than spare parts necessary for repair or maintenance, the consumer has the right to withdraw from the contract with regard to additional services or items;

9) in which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the package has been opened after delivery;

10) for the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts;

11) concluded through a public auction;

12) for the provision of accommodation services, other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract indicates the day or period of service provision;

13) for the supply of digital content that is not recorded on a tangible medium, if the performance began with the consumer's express consent before the deadline to withdraw from the contract and after informing the entrepreneur about the loss of the right to withdraw from the contract.

§7

Loyalty program

1. A person making a purchase on the apearl.eu website may receive loyalty points for the purchased products.

2. The number of loyalty points is indicated on the product page.

3. If the product is on sale or its price is lower than PLN 40, loyalty points will not be awarded.

4. The customer will receive loyalty points only if he places an order as a registered customer.

5. The possibility of exchanging loyalty points for a discount is possible in the "My Account" → "My Loyalty Points" tab.

6. The following point conversion is used: a) for each PLN 40 spent. registered customer gets 1 point. b) 1 point received may be exchanged by a registered customer for PLN 1. discounts on your next order.
